How Tax Treatment Can Differ Across Investment Structures

The tax treatment of an investment can depend on the structure through which it is held. Two individuals may hold exposure to similar underlying assets but have different tax obligations because of their residency status, holding period, product structure, transaction activity and applicable law.

Three Areas to Understand

1. Ownership

Assets may be held directly in an individual’s name or through a pooled fund structure. The ownership arrangement affects reporting, transaction records and the point at which tax may arise.

No structure provides the same treatment for every individual or every transaction.

PMS: Direct Holding Arrangement

Under a PMS arrangement, securities are generally held in the investor’s name, subject to the terms of the agreement. Buying or selling securities can create taxable events, and the applicable tax treatment depends on the transaction, holding period and prevailing law.
